Arbitration/Mediation

As An American Arbitration Association and former NASD Arbitrator, I have presided over hundreds of arbitration hearings serving as sole arbitrator, as panel chair and as panel member. I have written well in excess of 100 opinions for the AAA alone. Also, available for private arbitration.

  • Served as panel chair in several professional malpractice cases including case where claim was $1 Billion.
  • Served as chair and panel member in several health care industry claims including one case involving claim of over $30 Million and counter-claim over $7 Million.
  • Served as Panel Chair in matter involving multi-million dollar dispute over insurance commissions.
  • Served as sole arbitrator in many real estate related claims.
  • Served as sole arbitrator in 2 separate disputes among owners of professional sports franchise.
  • As member of AAA Sports Panel, has served as sole arbitrator in numerous claims involving Olympic level athletes.
  • Served as sole arbitrator, panel chair and panel member in disputes among business owners with multi-million dollar claims
  • Served as sole arbitrator in many consumer claim cases encompassing several industries including automobile sales, consumer loans, credit cards and retail acquisitions.

Being a CPA, in addition to an attorney and businessman, makes me particularly valuable in arbitrations involving financial issues, complicated damages calculations and expert testimony of CPAs.

Mediation

As an active Florida Supreme Court Certified Mediator for over 25 years, my mediation practice has involved me in a wide array of cases, some involving multiple parties and very complex subject matters. As mediator in well over 2,000 matters, subject matters faced include: business and contract disputes, real estate transactions, loan workouts and foreclosures, securities issues, health care issues, franchisee/franchisor disputes, construction lien cases, ADA matters, professional malpractice (legal, accounting, surveying, appraising, etc.), employment and labor matters, insurance disputes (including property, health and disability), condominium association disputes, sports and entertainment related issues, divorce, custody and other family issues, civil rights and domestic violence issues, personal injury, workman’s compensation and other complex litigation.

Mediation Philosophy

My mediation training, including training in facilitative and transformative mediation, covered various methods of dispute resolution. I feel very comfortable within the mediation process and have a wide array of experience to draw from in working with the parties. I try to tailor my approach to the circumstances, parties and personalities involved in a given session. A famous comedian once said that how an audience reacts to his first two jokes could cause him to change his entire act. I try not to buttonhole myself into one particular style. My strengths include listening, discerning the goals and concerns of each party and

then attempting to form bridges in leading those parties towards a viable resolution. Utilizing the logic of a CPA and the creativity of a former stand-up comedian and actor, I have found my ability to connect with parties in caucus sessions beneficial in lifting barriers and eliciting positive communication.
